Understand your rights and entitlements
After separation, some parents are able to come to a civil and appropriate agreement between themselves for the care of their children. For many parents, these non-legally binding agreements achieve some sense of peace until there is a dispute that cannot be resolved, in situations such as this you may need to attend a family dispute resolution service or an alternative is to engage a lawyer to negotiate on your behalf regarding child custody.
Failing this, if you cannot resolve the issue with your ex partner through mediation or if domestic violence makes the situation unreasonable, an application to the Family Law Court for parenting orders maybe the only way to go. Court orders are binding and are enforceable.
Platinum legal can assist you in all aspects and areas of parenting disputes, orders and arrangements, from providing you with the support, advice and tools to assist you in negotiation with your ex partner or in court proceedings, we understand that each family is different and recognise that your needs are unique.
Furthermore, it is not always parents that make applications to the Family Law Court.
What to bring to your appointment
We ask you to bring any Court documents that you have, any letters or correspondence from your partner or partner's lawyers and any documents that you feel are important to you. This will assist us at your first appointment so that our lawyers can have a look over them when they meet with you. In regards to financial and property matters, lists and details of any kind pertaining to and including current superannuation statements, joint and separate assets and liabilities and a marriage certificate if you are still legally married, if you have any other information that you feel is relevant please include that also.
