When do I apply?
You can apply for a divorce if you have been separated for a period of 12 months or more. It is a no blame jurisdiction.
This means that the relationship must have irretrievably broken down, which party is to blame is not relevant. In cases where there are children involved under the age of 18 years old, a Divorce will only be granted if the Court is satisfied that proper arrangements have been made for the children. There are also other requirements, the above, are simply some examples. |
Who can apply ?If the two parties agree, they can make a joint application. In cases where the other party does not agree, you can apply on your own. .
However it is still necessary that you serve your application on the other party before the Divorce proceedings are heard. On the occasion that the other party objects to the divorce, the Court will still grant a divorce provided procedural and evidence requirements are met. In some cases it is possible to obtain a Divorce Order even if the separation has taken place under the same roof. |
Can I get started ?With other issues pertaining to the relationship such as property settlements, financial issues,
as well as child custody and visitation arrangements, you are not prohibited in moving forward with these issues prior to the one year separation time period that is only applicable for divorce cases, your Divorce will be treated as a separate Court proceedings. |
After the hearing...
Once a divorce order is granted at the divorce hearing your divorce does not usually become finalized until one day and one month after your divorce hearing.
It is best not to arrange or finalize any arrangements to remarry until the court has had time to fix the date to which your divorce is to become final. |
